General Terms and Conditions

Terms

1. TradeMania: represents an ecosystem comprising TradeMania websites, mobile apps, clients, applets and other applications designed to provide TradeMania services, and which also encompasses independently-operated platforms, websites, and clients within the ecosystem.

2. Account: represents account on the TradeMania platform, which comprises of main accounts and sub-accounts that are opened by TradeMania, and a distinct and individualized account registered under the User's name. This account contains all of the User's personal information, transactions, and actions on the platform.

3. Execution: represents the execution of Client order(s) by the Company acting as the User's counterparty as per the terms of the present agreement.

4. KYC: represents “know-your-customer” define by TradeMania to identify Users. TradeMania may request upon its sole discretion any document to be provided by the User including without limitation to the copy of the passport or ID, utility bill, certificates showing the management and beneficial ownership. TradeMania may scrutinize and investigate User transactions, or comply with any applicable law or regulation.

5. Operations: represents actions performed at the User's Account, following an order placed by the Client, connected with but not limited to crediting of funds, return of funds, opening and closing of trade transactions, positions and/or that relate to financial instruments.

6. Market: represents the market on which TradeMania and its instruments are subject to use.

7. Game & Tournament: represents organized competitions or contests that are typically played with a set of rules defined by TradeMania. These contests often involve multiple players or teams, and the winner(s) or champion is determined according to the rules of each specific game or tournament set by TradeMania.

8. Prices & Pool: represents the price pool allocated for each game or tournament. These prices are specified to winner(s) or champion according to the percentage allocated for the game or tournement.

9. Services: represents the various services offerings provided to Users by TradeMania that are based on the internet and/or offered through TradeMania's websites, mobile applications, clients, and other forms of access. This includes, but is not limited to, the various components and platforms within the TradeMania ecosystem.

10. TradeMania Platform: represents a digital system available on the internet that includes all software and technology.

11. Rules: represents all types of guidelines, explanations, official statements, authorization letters and other related materials, both past and future, as well as all laws, application guidelines, product procedures and notifications published in the Help Center or within products or services.

12. User: represents all individuals, entities, or organizations that utilize TradeMania services by accessing, downloading, or using them, and who comply with the requirements and conditions set up by TradeMania.

General Information

1. Terms and Conditions Binding

   The Terms and Conditions and all other obligations and rules detailed in writing in TradeMania (collectively, the "Terms and Conditions") are by and between TradeMania, Inc., its partners, parent companies, subsidiaries and affiliates, (each, “TradeMania”, “TM”, “TradeMania Operators”, “us”, ‘our”, or “we”, or “Company”) and everyone who uses TradeMania (each, "you," "user," or "player", or “Client”). By using TradeMania, creating an account, and/or participating in any tournament or service offered on or in TradeMania, you accept and agree to be bound by all terms, conditions and notices contained or referenced in TradeMania, including the most current version of the Terms and Conditions. We may modify the Terms and Conditions at any time, and may make you aware of any material changes. However, your continued use of TradeMania at any times, including following such modifications whether you are aware of such modifications or not, signifies your acceptance of those modifications. In summary you are responsible for reviewing the Terms and Conditions periodically in order to stay aware of modifications.

   TradeMania may change as TradeMania’s business adjusts, in which case, the changed operators shall perform their obligations under these terms with you and provide services to you, and such change does not affect your rights and interests under these terms. Additionally, the scope of TradeMania operators may be expanded due to the provision of new TradeMania services, in which case, if you continue to use TradeMania services, it is deemed that you have agreed to jointly execute these terms with the newly added.

2. Governing Law and Disputes

   By registering for an account and/or participating in any tournament or service offered on or in TradeMania, you agree that any dispute that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action. You further agree that any dispute shall be resolved pursuant to arbitration as set forth in our Terms of Service.

3. Entire Agreement

   The TradeMania Policies constitute the entire agreement between you and us pertaining to your participation and supersede all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of the TradeMania Policies shall be deemed or shall constitute a waiver of any other provisions (whether or not similar), nor shall any waiver constitute a continuing waiver unless otherwise expressly provided. The TradeMania Policies cannot be modified on an individual basis by any person affiliated, or claiming affiliation, with TradeMania. Nothing in this subsection will prevent us from modifying the terms of these Terms and Conditions and posting such modifications.

4. Severability

   If any portion of the Terms and Conditions is deemed void or unenforceable, then that provision shall be deemed severable from the Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions.

5. Changes and/or Terms and Conditions

   TradeMania reserves the right to change, modify, update, discontinue, remove, revise, delete or otherwise change any portion of these Terms and Conditions, in whole or in part, at any time without further notice. For changes to these Terms and Conditions that we deem material, we will place a notice by revising the link on the homepage to read substantially as “Updated Terms and Conditions” for an amount of time that we determine in our discretion. If you access or use in any way after the Terms and Conditions have been changed, you will be deemed to have read, understood and unconditionally consented to and agreed to such changes. The most current version of these Terms and Conditions will be available and will supersede all previous versions of these Terms and Conditions.

Eligibility, Obligations & Player Conduct

1. Eligibility

   1. To be eligible to use a TradeMania Account and/or register and open an account and/or participate in any tournament and services offered by TradeMania, you represent and warrant that:

      • As an individual, you are at least 18 or are of legal age to form a binding contract under applicable laws.
      • As an individual, legal person, or other organization, you have full legal capacity and sufficient authorizations to enter into these Terms.
      • You have not been previously suspended or removed from using the TradeMania Platform or the TradeMania Services.
      • You do not have an existing TradeMania Account.
      • You are not resident, located in or otherwise attempting to access the TradeMania Platform or the TradeMania Services from, or otherwise acting on behalf of a person or legal entity that is resident or located in, a Restricted Location. For the purposes hereof, “Restricted Location” shall include North Korea, Iran, Syria, United States, Australia, Aruba, Bonaire, Cyprus, France, Netherlands, Saba, Spain, Statia, St. Martin, United Kingdom, Israel, and such other locations as designated by TradeMania from time to time as a “Restricted Location” for the purposes hereof.
      • If you act as an employee or agent of a legal entity, and enter into these Terms on their behalf, you have all the necessary rights and authorizations to bind such legal entity and to access and use the TradeMania Platform and TradeMania Services on behalf of such legal entity.
      • Your use of the TradeMania Platform and the TradeMania Services will not violate any and all laws and regulations applicable to you or the legal entity on whose behalf you are acting, including but not limited to regulations on anti-money laundering, anti-corruption, and counter-terrorist financing.

      Kindly note that there are legal requirements in various countries which may restrict the products and services that TradeMania Operators can lawfully provide. Accordingly, some products and services and certain functionality within the TradeMania Platform may not be available or may be restricted in certain jurisdictions or regions or to certain users. You shall be responsible for informing yourself about and observing any restrictions and/or requirements imposed with respect to the access to and use of the TradeMania Platform and the TradeMania Services in each country from which the TradeMania Platform and the TradeMania Services are accessed by you or on your behalf. TradeMania Operators reserve the right to change, modify or impose additional restrictions with respect to the access to and use of the TradeMania Platform and/the TradeMania Services from time to time at their discretion at any time without prior notification.

      The users may not be able to make deposits to their account or participate in tournaments. The users may be prohibited from making deposits to their account and may be banned from participating in tournaments.

   2. You represent and warrant that all information you supply to TradeMania is complete, accurate and current. Knowingly submitting incomplete or inaccurate information, or failing to update and maintain current, complete and accurate information, may result in immediate termination of your account and forfeiture of any prizes or winnings. From time to time, TradeMania may request you provide updated and/or current account information and you agree to provide such information in a timely fashion.

2. Additional Persons Not Eligible

   In addition to the restriction set forth in Section 2.1, the following persons are ineligible to receive any prize offered by TradeMania: employees, officers, and directors of TradeMania, and its subsidiaries, affiliates and related companies and any other person with access to non-public information regarding the operation of any game or tournament or service offered by TradeMania.

3. Location of Users

   You are subject to all laws of the city, state, province and country in which you reside and from which you access to TradeMania Platform. You are solely responsible for complying with those laws. Access to TradeMania may not be legal for some or all residents in certain jurisdictions. You agree that TradeMania cannot be held liable if laws applicable to you restrict or prohibit your use of or participation with TradeMania services and platform. TradeMania makes no representations or warranties, express or implied, as to the lawfulness of your accessing or participating in any game or tournament or use any service offered by TradeMania. No person affiliated, or claiming affiliation, with TradeMania has authority to make any such representations or warranties.

   TradeMania reserves the right (but has no obligation to you) to monitor the location from which you access and to block access from any jurisdiction in which participation or access may be illegal or restricted. TradeMania may block access to players using proxy servers or any other method which is intentionally used in order to conceal a player’s true location. TradeMania may further block players if you are in a jurisdiction where the services are restricted or if the company is unable to accurately verify your location. We may require any participant receiving any prize to provide us with proof that you are, or at the time the subject game or tournament was played, eligible to participate according to the Terms and Conditions. If we monitor your access or participation with TradeMania, we shall not be liable for the effectiveness of such monitoring.

   By accessing, using, downloading in any way any materials in TradeMania browsing TradeMania, creating an account and/or participating in any tournament or service offered by or through TradeMania, you represent and warrant that you are doing so in compliance with the Terms and Conditions and agree to indemnify and hold harmless TradeMania from any liability, claims, and damages (including attorneys' fees) arising out of or related to your violation of these Terms and Conditions.

   If the User's country imposes any fees or taxes on the company's services, TradeMania will not be responsible for these charges and will not be held liable for any such fees or taxes.

   VOID WHERE PROHIBITED OR RESTRICTED BY LAW. If you open an account and/or participate in any game, tournament offered in TradeMania and/or use TradeMania Platform while located in a prohibited jurisdiction, you may be in violation of the law of such jurisdiction and will be in violation of the Terms and Conditions and subject to having your account suspended or terminated. In addition, and without limiting any rights or remedies available to Us, in the event of any violation of the Terms and Conditions, all winnings, Game Credits and/or Bonus Bucks (if any) may be voided, and in the event such winnings have already been withdrawn by you, recouped by Us, at our sole and absolute discretion.

4. Taxes

   The Company does not assume responsibility for any taxes that may be applicable according to the regulations of your location, whether you participate in one of our services or receive a prize as a result.

5. Information Required

   Upon registering an account, you will be required to submit the following information:

   • An alias that will be your username.
   • A password.
   • Your e-mail address.

   TradeMania reserves the right, in its sole discretion, to change, suspend and/or terminate aliases as TradeMania deems fit.

   Upon establishing a positive game or tournament account balance for entry fee tournaments, you are required to submit and maintain at all times the following current and correct information:

   • Full name.
   • Permanent physical residential address and a billing Zip Code in a jurisdiction in which participation in the game or tournament you select in TradeMania is unrestricted by law.
   • Credit card or other payment information, which information and/or signing authorization may be verified by TradeMania.

   Credit cards or other payment methods must be associated with your personal information (not those of another individual and not associated with a business account).

   In addition, the company may request a social security number in order to send you an IRS, or other appropriate form, as required by Internal Revenue Service or other jurisdiction’s tax regulations. Failure to provide your social security number at that time, or failure to complete any other tax documentation may result in tax withholding and/or TradeMania's inability to credit your account for any winnings.

   Each time you login wishing to participate in TradeMania services, the company will verify the location from which you are playing. In order to play, the company may require to enable Locations Permissions on your mobile device while TradeMania is in use. If you are located in a restricted area, you will not be able to access or use TradeMania's services or participate in its prize pools.

6. Recommended Devices, System Requirements and Configuration

   You understand that by participating in TradeMania services, you may be playing against other players using different types of devices. TradeMania shall not be liable for damage that occurs or issues you may encounter if your device does not meet the minimum system requirements or as a result of playing against user of different types of devices.

   TradeMania recommends using a modern phone with the capability to support the application and platforms for mobile usage. For desktops and laptops, TradeMania recommends using a Windows device that can support the platform. In all cases, TradeMania suggests using the latest version of a browser with automatic updates enabled for optimal performance.

   For optimal performance, TradeMania services will function best when your computer or mobile device is updated to the latest version. TradeMania cannot be held liable for any damage or issues that may occur, even if the device does not meet the minimum system requirements.

7. Acknowledgment of Proprietary Rights

   By registering for an account and/or participating in any game or tournament and/or use any service offered on TradeMania, you acknowledge that all information contained in TradeMania may be protected by one or more valid copyrights, patents, trademarks, trade secrets, or other proprietary rights and that all such rights are owned by TradeMania. TradeMania neither warrants nor represents that your use of materials displayed in TradeMania platform will not infringe rights of third parties. TradeMania assumes no liability or responsibility for any errors or omissions in the content of TradeMania.

   Any communication or material you transmit to TradeMania by electronic mail or otherwise, including any data, questions, comments, suggestions, etc. will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by TradeMania or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, TradeMania promotion, marketing and posting. TradeMania is free to use any ideas, concepts, know-how or techniques contained in any communication you send to TradeMania for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information, without any additional compensation or other liability or obligation to you.

   The trademarks, logos, and service marks (collectively the "Trademarks") displayed in TradeMania, are registered and unregistered Trademarks of TradeMania and/or others. Nothing contained in TradeMania should be construed as granting any license or right to use any Trademark displayed on the Site without the written permission of TradeMania or such third party that owns the Trademark. Your use of any Trademark displayed in TradeMania, except as provided in the Terms and Conditions, is strictly prohibited.

8. Promotional Activities

   By registering for an account, you agree that TradeMania may display your username and game or tournament records. By accepting any prize pool from TradeMania, you agree to allow the company to print, publish, broadcast and use, worldwide, in any media and at any time, your username, picture, voice, likeness, and/or biographical information for promotional, marketing or related purposes without additional compensation.

Account Management

1. Limitations on Number of Accounts

   You may establish only one account per person and only one account per device or IP or physical address, to participate in the activities offered on TradeMania. Multiple accounts may not be created sharing the same name, email, credit card or PayPal account. TradeMania reserves the right to monitor all activities on TradeMania, including any effort to establish multiple accounts. In the event TradeMania discovers that you have violated the number of accounts allowed, all additional accounts will be closed without notice and continued violation may result in the termination of any and all of your accounts and TradeMania may void any associated winnings, Game Credits and/or Bonus Bucks and/or prizes pool to any or all of the account(s). TradeMania further reserves the right to deny access to anyone, including, but not limited to, those players who use proxy servers and/or IP addresses residing in certain geographical areas.

2. Credit Card Transactions, Game Credits and Demo Account

   Game or tournament Credits are defined as any credit to play a game or tournament deposited by TradeMania, in its sole discretion, into an account, including, but not limited to, promotional credits, entry fee credits, accounting credits, prize credits and gift credits. Game Credits are a free currency that can be used to enter tournaments and compete for prizes pool. Game or tournament Credits or funds displayed in a demo account have no cash value, cannot be withdrawn and are considered Virtual Assets under our Terms of Service. Unused Game or tournament Credits will expire after six (6) months of inactivity (i.e., not logging into your account during a six (6) month period). Funds in Demo account is defined as a free currency, provided by TradeMania that can be used to enter games or tournaments or services and compete for prizes pool.

   TradeMania reserves the right to set expiration dates or other limits on all Game or tournament Credits and Demo account. TradeMania may void the Game Credits and Demo account balances of any dormant account. A dormant account is an account that has not been logged into for greater than six (6) months. Entry into cash tournaments, with real cash, Game or tournament Credits and Bonus Bucks may be prohibited in your jurisdiction. Void where prohibited or restricted by law.

   TradeMania may utilize Card.io technology to scan credit card information. “THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

3. Fraud and Abuse

   Fraud and abuse relating to the access and use of TradeMania is strictly prohibited. In accessing TradeMania or participating in any activities, products or services offered by or through TradeMania, you represent and warrant that:

   • All information you supply is complete and accurate and not in violation of any applicable laws, regulations or these Terms and Conditions.
   • You will not circumvent or attempt to circumvent any provision of the Terms and Conditions or engage in any activity that interrupts or attempts to interrupt the operation of TradeMania.

   Users engaging, participating or displaying behavior that may be interpreted, in TradeMania's sole and absolute discretion, as the use of unfair methods in TradeMania, including but not limited to:

   1. The opening and/or use of multiple accounts.
   2. The use of unauthorized or altered software or hardware to assist play (including the use of bots, bot nets, jail broken devices or rooted devices, collusion with bots and/or use of cheat programs such as debuggers, clock-skewing software and memory scanners).
   3. Intentionally poor play in certain games or tournaments or any services in order to achieve a broader competitive advantage.
   4. Collusion with other players.
   5. The deliberate transfer of money between accounts (i.e., "money laundering").
   6. Harassment of other participants.
   7. Posting of objectionable material.
   8. Any breach of the Terms and Conditions or TradeMania Policies.
   9. Any breach of the security of your account or TradeMania platform or services.
   10. Any other act (whether through the use of automated technology or otherwise) that unfairly alters your chance of winning or constitutes the commission of fraud (collectively, "Abuse").

   Engaging in any of the above or any similar behavior, while playing TradeMania, may subject you to immediate consequences (as determined by TradeMania in its sole and absolute discretion), including without limitation: (1) immediate termination of your account and blocking of TradeMania access; (2) forfeiture of any prizes, winnings, Game or tournament Credits, Demo account and any other item of value (if any) that you may otherwise have been entitled to receive; (3) disgorgement and/or recoupment of any prizes, winnings, Game or tournament Credits, Demo account and other items of value already received by you; and (4) in the case suspected illegal activity, TradeMania may disclose relevant information to the appropriate authorities as deemed necessary. In the investigation of an alleged Abuse, TradeMania may request additional information from you. You agree to provide all reasonable and relevant information as requested by the Company. Without limiting any provision of the Terms and Conditions, TradeMania expressly reserves the right to institute or seek any injunctive relief, civil and/or criminal proceedings against you and/or any of your co-conspirators arising out of or related to your commission of Abuse, including the right to recover fees and expenses (including attorneys' fees) and the right to report you and such Abuse to any and all relevant regulatory authorities or governmental agencies.

4. Account Maintenance Fee

   An inactive account is any account in which the user has not logged in for six (6) consecutive months. For any inactive account, TradeMania may assess a maintenance fee of $3.50 per month ("Monthly Maintenance Fee"). The Monthly Maintenance Fee is a real charge on your account's. The Monthly Maintenance Fee is only applicable to the funds that are in a player's account. If the account's cash balance reaches $0 (zero dollars), the Monthly Maintenance Fee will be suspended. TradeMania may, but is not obligated to, notify account owners via e-mail of their inactivity and the imposition of the Monthly Maintenance Fee.

5. Withdrawal Requests

   Players may request a withdrawal of funds from their available account balance at any time. Game or tournament Credits and funds in Demo account have no cash value and cannot be withdrawn and are considered “Virtual Assets” as defined in our Terms of Service. Any withdrawal of real money from your account, including total or partial amounts, will trigger a forfeiture of ALL funds in Demo account. Processing of requested funds back to a credit card or PayPal account may take up to seven (10) business days. TradeMania reserves the right to freeze a user's account and/or delay a request for withdrawal of funds pending completion of any investigation of reported or suspected Abuse by a user requesting withdrawal of funds. User’s failing to comply with an investigation of or Users found to have engaged in Abuse, may have their winnings voided.

   If a current credit card or PayPal account is not available to receive withdrawals, then a player may request to receive a withdrawal by check. Users are required to actively claim any check produced by a request for withdrawal of funds from their account. TradeMania reserves the right to assess a check request processing fee of $1.75 for any check request in an amount less than $10.00. Users may combine several checks that are less than $10.00 to produce a check greater than $10.00 for purposes of waiving the $1.75 check processing fee. Subject to TradeMania’s funds availability confirmation process, check requests are systematically processed and may take up to eight (8) weeks to process.

   Checks not claimed within thirty (30) days from the date of the check will become void and the amount of the check will then be re-deposited back to your account.

   If your account is closed by TradeMania for a violation of the Terms and Conditions, your winnings, real money from your account may be voided and not returned to you. In such an event, TradeMania may use voided cash winnings to defray the costs of administration and enforcement of the Terms and Conditions or allocate such monies to secondary games or tournaments.

6. Account Cancellation

   You may cancel your account by contacting TradeMania at info@trademania.com. Your account is not considered cancelled until you have received confirmation of such cancellation from us. You may not cancel your account to evade an investigation. If you do not agree to the terms of the TradeMania Policies, your sole remedy is to not use TradeMania and to cancel your account. In some cases, cancellation of your account may be retracted by you, however, in other cases, cancellations may be permanent and not subject to retraction.

Games & Tournaments

1. Skill Matching

   Our main goal is to provide services, games and tournaments that offer a competitive gaming experience that is fun, fair and exciting for all players.

   For all competitions, TradeMania ensures the game conditions are similar for all players within a specific competition.

2. Odds and Prizes Pool

   The results of all games and tournaments offered by TradeMania may depend on various factors, such as the number of players participating, Entry fee, ect.

   Prizes Pool is generally cash amounts, which are deposited directly into the winner’s account. The guaranteed cash value of prizes offered in “Limited Entry Tournaments” (Games or Tournaments with a designated minimum number of players and a maximum number of players) or “Unlimited Entry Games or Tournaments” (Games or Tournaments with a designated minimum number of players, but no maximum number of players) will be disclosed at the beginning of each game or tournament. The cash value of prizes offered in “Progressive Games or Tournaments” or “Progressive Rush Games or Tournaments” (Games or Tournaments with a designated minimum number of players, but no maximum number of players) is not guaranteed and instead is determined by the number of players participating in the game or tournament.

   TradeMania may set an initial starting prize that increases with each subsequent entry.

   All “Limited Entry Games or Tournaments” that do not reach the maximum number of players may be cancelled and any entry fee paid by the player will be refunded to the player’s account in the form of a Game Credit. If a Limited Entry Game or Tournament closes for maintenance or technical problems, the entry fee paid for the Game or Tournament, by all players, will be refunded to the players’ accounts in the form of Game Credits.

   All “Unlimited Entry Tournaments” will have a predefined end time when it will close, and all prize(s) are guaranteed to be award provided that at least three (3) players participate prior to the predefined end time.

   All “Progressive Tournaments” or “Progressive Rush Tournaments” will have a predefined end time when it will close, and all prize(s) pool are guaranteed to be award provided that at least three (3) players participate prior to the predefined end time.

3. Winners Lists

   A preliminary list of winners will be posted in TradeMania immediately following each Game or Tournament as determined by the Company.

4. Determination of Winners

   The results and winners of each Game or Tournament offered will be determined by TradeMania, and such determinations are final. By registering and/or participating in any Game or Tournament in TradeMania, you agree to be bound by these determinations.

5. Game Rules

   Rules for each specific game offered in TradeMania can be found within the Game Rules for each game.

Limitation of Liability

1. Unauthorized Charges

   TradeMania is not liable for any loss caused by any unauthorized use of your credit card or other method of payment by a third party in connection with TradeMania. If you wish to dispute a charge to your account, you must do so within 180 days of the alleged unauthorized charge(s) otherwise such a dispute will be deemed waived by TradeMania. Upon notification of a disputed charge, the Company may conduct an investigation to determine the amount, if any, considered unauthorized.

   Attempts to defraud TradeMania through the use of credit cards or other methods of payment, or your failure to honor legitimate charges or requests for payments may result in immediate termination of your account, forfeiture of prizes and/or civil and/or criminal prosecution.

2. Hacking, Tampering, or Unauthorized Access

   By registering for an account and/or participating in any Game or Tournament offered by the Company, you agree that TradeMania is not responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of TradeMania or your account. You are responsible for the security of your account. If you give someone access to your account and they conduct a transaction without your knowledge or permission, you are responsible for any resulting use. Such transactions are not considered to be unauthorized by TradeMania.

   Any attempt to gain unauthorized access to our systems or any account, interfere with procedures or performance of TradeMania, or deliberately causing damage to or undermining TradeMania, may subject you to civil and/or criminal prosecution and result in immediate termination of your account and forfeiture of any prizes.

3. Accounts for Individual Use Only

   You are solely responsible for all obligations relating to your account and for compliance with these Terms and Conditions. You are entitled to all benefits accruing to you as a result of being the account holder. You may not allow any other person to access your account, access TradeMania, accept any winnings, or participate in any Game or Tournament using your account. Your account is not transferable. By registering and/or participating in any Game or Tournament offered by Trademania, you agree to indemnify, defend, and hold TradeMania harmless from or for any claims, liability, damages, and/or costs (including attorneys' fees) arising from any use of your account by any person.

4. Account Availability

   TradeMania does not guarantee that access to your account will be available at all times and/or in all geographic locations. TradeMania is not liable for any loss which may be caused by your inability to access TradeMania platform or your account.

Company Fees

The determination of fees will be at the sole discretion of TradeMania, and shall be considered final. By registering and/or participating in any game or tournament on the TradeMania platform, you expressly agree to abide by the fees established by the company.

Breaching User

To comply with the terms of service, Users are required to adhere to the rules. In addition, Users are expected to follow the provisions of the law and the guidelines established by the company's legal requirements, as well as its Terms and Conditions, Terms of Service, and Privacy Policy.

If you violate the company's rights, misuse its name, trademarks, or intellectual property, cause harm to its reputation, or breach the terms, conditions, and regulations specified in its Terms and Conditions or Terms of Service or Privacy Policy will be subject to legal prosecution. The violator or user at fault will be required to provide appropriate compensation that corresponds to the material or moral harm or losses incurred by the Company. The value of such compensation will be determined promptly.
